A will can be simple to produce but it must do a few specific things to be effective: it must name a personal representative, someone to handle your affairs after death. If you have minor children, it must name a guardian. It must spell out exactly how you want your property distributed. The more vague your instructions, the more likely it is that your family will end up in court.

A simple will can avoid such a situation. For larger estates, or special situations, such as blended families or second marriages, you may want to set up a trust. To make sure things are done right, you’ll want to hire a lawyer who specializes in estate planning. Attorney’s fees for proper estate planning are not as much as many people seem to fear, and such costs are usually significantly less than the costs that can be incurred when someone dies without these documents.
