Maryland law requires that anyone in possession of the Will of a deceased individual must file that Will promptly with the Maryland Register of Wills in the county where that individual lived at the time of death, even if no probate is required. If there is to be a probate, the Personal Representative (or Executor) of the Will must complete the probate process before distributing the decedent’s assets to the beneficiaries.
The Probate Process
The Probate process can be complicated and can take a long time. Some of the Personal Representative’s many duties are to organize and collect financial records, secure property, notify various agencies of the decedent’s death, determine what kind of estate to open, file various legal documents with the Register of Wills, decide which creditors and expenses must be paid, decide how to value and distribute assets, and determine if federal or state estate taxes are due. They are also responsible for filing accountings with the Orphans Court or Register of Wills in their county. Mistakes during this process can delay the final distribution of assets, and significantly increase probate expenses and a Personal Representative can be held personally liable for debts if the estate is not probated correctly.
